Hereinafter referred to as Flat4Bug,
And Any natural person making a purchase via the Website www.flat4bug.fr,
Hereinafter referred to as "the Buyer".

These conditions are intended to define the terms of distance selling between Flat4Bug and the Buyer, from the order to payment and delivery.
They regulate all the steps necessary for placing the order and ensure the follow-up of this order between the contracting parties.
Placing an order on the Site www.flat4bug.fr published by the Company Flat4bug implies unreserved acceptance of the provisions of these conditions.
The Buyer declares to be at least 18 years old and to have the legal capacity or to hold parental authorization allowing him to place an order on the Site.

ARTICLE 1: COMPLIANCE AND AVAILABILITY OF PRODUCTS

The products offered for sale by Flat4Bug are those appearing on the Site on the day of consultation of the Site by the Buyer.
The products are offered for sale within the limits of available stocks.
In case of error on the availability of a product ordered, Flat4Bug informs the Buyer by e-mail as soon as possible. The Buyer will have the option of having the product replaced by another of equivalent quality and price, or of canceling the order.
The products offered for sale are described and presented with the greatest possible accuracy. In case of error or omission in this presentation, the responsibility of Flat4Bug could not be engaged. The photographs and texts illustrating the products have only an indicative value and do not enter into the contractual field.

ARTICLE 2: PRICE

The prices displayed on the Site are indicated in euros, all taxes included, excluding postage and order processing costs.

The payment of the order is made by credit card or check.
With regard to payment by online bank card, only cards bearing the acronym "CB" are accepted, cards bearing the brand name "VISA", "EUROCARD" or "MASTERCARD" accepted in France, or cards issued in the framework of international networks, approved by the Economic Interest Group (GIE) Cartes Bancaires.
The validation of the order by means of the number of the credit card and the expiry date constitutes a mandate to pay the price of the said order.
Flat4Bug uses the BNP AXEPTA 3D Secure V2 (Visa/Mastercard) and Paypal security service.
Confidential data relating to the means of payment are not accessible by Flat4Bug, but managed directly by the security service.

ARTICLE 3: ORDER

Any order implies express and irrevocable acceptance, by the Buyer, of the prices and descriptions of the products available for sale, as well as of these conditions.
After validation of the order, Flat4Bug sends the Buyer a confirmation e-mail to the e-mail address indicated during the order.

ARTICLE 4: DELIVERY

The products ordered are sent to the delivery address indicated by the Buyer when placing the order.
Participation in the costs of logistical preparation and shipping is inclusive of VAT. All deliveries are announced by email.
The maximum delivery time is 15 days from the order of the product on the Site.
In the event of a delay in delivery of more than seven days, if this is not due to a case of force majeure, the Buyer has the possibility of canceling his order.
It will follow the refund of the order within 6 days.

ARTICLE 5: AVAILABILITY

In case of unavailability of the product ordered, Flat4Bug informs the Buyer by sending an e-mail to the e-mail address indicated when ordering.
The Buyer then has the option either to be delivered a product of equivalent quality and price, within the limits of available stocks, or to be reimbursed for the price of the order within thirty days of payment of the order.
The delivery costs of the new product are borne by Flat4Bug.

ARTICLE 6: RIGHT OF WITHDRAWAL

The Buyer has a period of seven clear days, from the receipt of the products or from the acceptance of the offer for the provision of services, to exercise his right of withdrawal without having to justify reasons or to pay penalties, with the exception, where applicable, of return costs.
If the seven-day period expires on a Saturday, Sunday or a holiday or non-working day, it is extended until the first following working day.
In the event of exercise of the right of withdrawal, Flat4Bug reimburses the Buyer for all the sums paid, as soon as possible and at the latest within thirty days following the date on which this right was exercised.

ARTICLE 7: RETURN

From the date of receipt of his order, the Buyer has a period of 5 days to return a product. After this period, the products delivered will be deemed to be compliant and accepted by the customer, and Flat4Bug reserves the right to refuse the exchange, credit note or refund.
The returned item must be in good condition with the original packaging in good condition as well.

ARTICLE 8: GUARANTEES AND LIABILITY

Flat4Bug responds to defects of conformity existing during the delivery of the product. It also responds to any lack of conformity resulting from the packaging, the assembly instructions or the installation (when this has been charged to it by the contract or has been carried out under its responsibility.)
In case of delivery of a non-compliant product or in case of delivery of a product revealing a hidden defect, Flat4Bug undertakes either to reimburse the Buyer for the price of the product, or to exchange the product for another identical one in depending on available stocks, or to exchange it for a product of equivalent quality and price depending on available stocks.
The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.
The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.
These provisions are not exclusive of the right of withdrawal defined in article 8 hereof.
Products modified, repaired, integrated or added by the Buyer or any other person not authorized by the supplier of the said product or service are excluded from the warranty.
The warranty does not cover apparent defects.
The warranty will not cover products or services damaged during transport or misuse.
Flat4Bug cannot be held liable in the event of a breach of contractual obligations due to a fortuitous event or a case of force majeure, as defined by case law.

ARTICLE 9: PERSONAL DATA

Flat4Bug undertakes to respect the confidentiality of the personal data communicated by the Buyer on the Site and to process them in compliance with the Data Protection Act of January 6, 1978.
In accordance with the Data Protection Act of January 6, 1978, the Buyer may exercise his right of access to the file, his right of opposition and his right of rectification or deletion for information concerning him by sending his request by e-mail. at the address fabien@flat4bug.fr or by post at the address 5 chemin de la pinède 06650 Le Rouret.

ARTICLE 10: INTELLECTUAL PROPERTY

All elements of the Site are protected by copyright, trademarks or patents.
They are the exclusive property of Flat4Bug.

ARTICLE 11: APPLICABLE LAW AND COMPETENT COURTS

These general conditions of sale are executed and interpreted in accordance with French law.
In the event of a dispute, the Buyer undertakes to contact Flat4Bug as a priority in order to try to resolve amicably any dispute that may arise between the parties.
In the absence of conciliation, the French courts will have sole jurisdiction.

ARTICLE 12: MODIFICATIONS TO THE GENERAL CONDITIONS OF SALE

Flat4Bug reserves the right to adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day of the order will be applied to each order.
